Welcome to the user agreement for Tradesmen.ie ("User Agreement"). The services available at http://www.Tradesmen.ie are provided by Barrowvale Technology Ltd T/A Tradesmen.ie. ("Tradesmen.ie ", "we", "us" or "our"), company registration number 330063, having its registered office at Jamestown, Ballybrittas, Co. Laois, Ireland. The term Service Provider refers to any person who provides a service of any kind, including their subcontractors, agents and employees. The term Service Buyer refers to any person looking for a service to be provided. The terms "You", "Your", "User", or "Users" refer to anyone accessing our services or web site for any reason.

This User Agreement describes the terms and conditions applicable to your use of our services available under the domain and sub-domains at http://www.Tradesmen.ie (the "Site"). If you do not agree to be bound by this User Agreement, you may not use or access our services.

 

You must read, agree with and accept all of the terms and conditions contained in this User Agreement, which includes those terms and conditions expressly set out below, before you may become a user of the Site.

 

Section headings are for reference purposes only and do not limit the scope or extent of the sections.

 

We may amend this User Agreement at any time either by e-mail or by posting the amended terms on the Site. Unless stated elsewhere in this User Agreement, all amended terms shall automatically be effective 30 days after they are initially posted on the Site.

Tradesmen.ie is an online service for Service Buyers looking for a Service Provider and to help them get a number of quotes for the service they require. All a Service Buyer needs to do is to fill in the simple form which asks them to describe the type of job they need to do and what type of Service Provider they are looking for. We then locate and inform the Service Providers in that area who are available and who are willing to quote for the job. The Service Providers are asked to contact the Service Buyer and organise to give them a quote. Service Buyers can post a job for free or they can opt to pay a fee for one or more enhanced services. Service Providers must pay a registration fee and a fee per lead for leads that they are interested in.

 

You may not use the Site if you are under the age of 18 or you are not able to form legally binding contracts or if you have been suspended from using the site.

 

While using the Site, you will not:

 

breach any laws or otherwise infringe the copyright, trade mark or other rights of third parties;

 

post, list or upload false, inaccurate, misleading or defamatory content (including personal information);

 

distribute or post spam;

 

distribute viruses or any other technologies that may harm the Site, or the interests or property of our users;

 

copy, modify, or distribute our copyrighted works or trade marks, or other content from the Site, without our express consent; or

 

If you are registering with the Site as a business entity, you represent that you have the authority to legally bind that entity.

Not acting within the spirit of the Agreement

Tradesmen.ie works to keep our services working properly and the users satisfied. Please report any problems, offensive content, and/or policy breaches to us.

Where you do not act within the spirit of this agreement, or for any other reason whatsoever, we may, at our sole discretion, take certain actions which include but are not limited to, issuing you with warnings, limiting, suspending, or terminating your user accounts, restricting or prohibiting access to, and your activities on, our site (including cancelling and removing jobs posted by you), delaying or removing hosted content, and taking technical and/or legal steps to keep you off our site. Not acting within the spirit of the Agreement may include, but is not limited to, some of the reasons below:-

In our sole opinion, you are creating problems (including for example the harassment of our staff or other users) or exposing us or another user to financial loss or legal liabilities;

Despite our reasonable efforts, we are unable to verify or confirm any information you provide to us; and/or

Negative feedback is received which we, in our sole opinion deem to be excessive.

We also reserve the right to cancel unconfirmed accounts and to modify or discontinue accounts that have been inactive for a long time.

You agree not to hold Tradesmen.ie responsible and to indemnify Tradesmen.ie for any loss you may incur as a result of Tradesmen.ie taking any of the actions described above.

Please note that your use of the Site remains at all times at the absolute sole discretion of Tradesmen.ie.

 

The Service Buyer can use the Site for free or he/she can opt to pay a fee to avail of one or more enhanced services. For example the Highlighted Post option which highlights the job for up to 2 working days and makes it stand out from the other jobs posted. The Highlighted Post option may result in a better response from Service Providers as they may perceive you to be more serious about getting the job done. However, we do not guarantee that you will get any response through any of the enhanced or paid services, or if you do that the Service Providers who do respond will be willing or able to carry out the work for you. Therefore, you will not be entitled to a refund if you do not get a response to the enhanced paid service or if the Service Providers who do respond are not willing or able to carry out the work for you. We may change the fee of certain enhanced services from time to time but the fee for each service will be clearly visible at the time when it is offered to you, and you can click the 'Buy Now' button if you are happy to proceed.

The Service Buyer must register with the Site in order to request contact from Service Providers. The Service Buyer must not post the same job more than once in any 6 month period. The Service Buyer is expected to provide feedback when each job is complete. A fair usage policy applies. If the Service Buyer is deemed to be excessively posting jobs without hiring Service Providers or if the Service Buyer has not provided feedback on previous jobs then the Service Buyer's use of the Site may be restricted or prohibited.

 

Service Providers must pay a registration fee and a fee per lead for leads that they are interested in. These and other fees are outlined in our Fees Policy, which we may change from time to time.

 

We do not tolerate spam (unsolicited commercial communications). Please set your mail filtering preferences to allow emails from Tradesmen.ie. You may not add other Site users, even a user to whom you have provided a service, to your mailing list (e-mail or physical mail) without their consent.

 

You may not use our communication tools to send spam or otherwise send content that would breach our User Agreement. We do not rent or sell your e-mail addresses.

 

 

By submitting User content to the Site (including, but not limited to creating your Account; posting a profile, posting a portfolio, posting a Project; sending messages through or to the Site). You hereby grant to the Site a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, display, and publish User content, under all User intellectual property and proprietary rights worldwide.

 

Nothing in this User Agreement shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents, subcontractors or employees or for any other liability that cannot be limited or excluded by law.

 

The Site merely gives Service Providers a list of jobs that have been submitted in their area and up to 4 Service Providers may contact the relevant Service Buyer to give a quote. We do not review communications between Service Providers and Service Buyers and we are not party to the actual transactions between Service Providers and Service Buyers. You will not hold the Site responsible for the actions or inactions of Service Providers or Service Buyers or other users, whatsoever. Your sole remedy under this agreement shall be to discontinue use of the Site.

 

While we go to great lengths to check that Service Providers are interested and are available to provide a service, we do not guarantee that a Service Provider will contact you. The onus is on you to make a decision on which Service Provider to use and to agree on the price and description of the job. 

Without prejudice to the generality of the foregoing, if you are a Service Buyer, you accept and agree that we have no control over, do not guarantee, and you will not hold us responsible for:

the delivery and/or completion of the service;

the quality or safety of the service provided;

 

the ability of a Service Provider to provide the service;

the qualifications of a Service Provider;

the relevant trade or industry accreditation of a Service Provider;  

the solvency of a Service Provider or a Service Buyer.

This is the case whether a job is posted for free or through the enhanced service such as the Highlighted Post option.

If you are a Service Provider, you accept and agree that we have no control over, do not guarantee, and you will not hold us responsible for:

the ability or the commitment of the Service Buyer to proceed with the job;

payment by the Service Buyers for your service.

 

We use techniques that aim to verify the accuracy and truth of the information provided by our users. However, we cannot and do not confirm, and are not responsible for ensuring, the accuracy or truthfulness of users' identities or the validity of the information which they provide to us or post on the Site.

 

We (including our subsidiaries, affiliates, officers, directors, subcontractors, agents and employees) shall not be liable to you for any loss or damage whatsoever(even where we have been advised of the possibility of such damage) that results from your use of the Site or that results from any dealings between Service Providers and Service Buyers. All direct, indirect or consequential loss or damage of any kind, including business losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us arising out of your use of the Site.

 

Regardless of the previous paragraph, if we are found to be liable, our liability, and the liability to you of our subsidiaries, affiliates, officers, directors, subcontractors, agents and employees, is limited to 120 euro in aggregate.

Whilst we use reasonable endeavours to respond to any telephone or written correspondence or enquiries within 3 working days, we cannot guarantee the time that we will respond.

Service Provider Qualifications and Insurance
Tradesmen.ie believes that its custom built rating system provides Customers with a useful aid in assessing the quality, value and reliability of a Service Provider. In addition to this Tradesmen.ie believes that by the Service Provider allowing themselves to be rated, it may provide Customers with a level of confidence regarding the Service Provider's ability. Tradesmen.ie checks the validity of the mobile phone number of all Trade Professionals prior to the Service Provider using the Website or the Service. Furthermore Tradesmen.ie requires that Service Providers submit at least 5 references from previous customers before they are allowed to use the website or service. The mobile numbers of all referees are verified and Tradesmen.ie also reserves the right to verify any reference by postal verification or by phone.

Tradesmen.ie does not verify or guarantee any Service Provider's trade accreditation or registration on the Customer's behalf nor whether any such documentation is still valid.

It is the responsibility of the Customer to satisfy themselves that the Service Provider is appropriately qualified and/or has the necessary insurance cover to complete the job prior to the Service Provider commencing the job. Where a specific trade accreditation or registration is required to be held by a Service Provider for a particular job Tradesmen.ie advises the Customer to request sight of evidence of the applicable accreditation or registration from the Service Provider prior to the commencement of the job.  It is also the responsibility of the Customer to check with their insurance adviser to see what insurance is required for the job. The Customer should check that they themselves are adequately covered and/or that the Service Provider has adequate cover prior to the Service Provider commencing the job. Where insurance cover is required to be held by the Service Provider Tradesmen.ie advises that the Customer should request sight of evidence of the service provider's insurance policy. However, if the Customer does not feel competent to inspect the Service Provider's insurance policy themselves Tradesmen.ie advises that the Customer should ask their insurance adviser to inspect it for them.

If you have a dispute with one or more users, you release us (and our officers, directors, subcontractors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

 

We do not tolerate spam (unsolicited commercial communications). We will not disclose your personal data to third parties other than the Service Providers who have registered with us and who have let us know that they are available and are interested in receiving these leads. The Service Providers are bound by similar data protection requirements. You can read our privacy policy here

 

If you object to this use and disclosure please do not use this Site.

 

You agree that you will only use this Site in accordance with the terms and conditions set out in this User Agreement. You agree to compensate us in full for any losses or costs (including reasonable legal fees) we incur arising from any breach by you of this User Agreement.

Severability
If any provision of this User Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforceable.
