Fees Policy

The following fees policy shall apply to users registering on or after 20th December 2021, as from the date of registration. For users who registered prior to 20th December 2021, the fees policy shall apply as from 28th December 2021.

Service Buyer

If you are a Service Buyer, you can post a job for free on the website at http://www.Tradesmen.ie/getquote.asp. In addition to this, you can post your job as a "Featured Job" highlighted at the top of the Browse Latest Jobs list for a certain period of time in return for a fee. The fee for featuring a job will be displayed to you at the time of posting the job.

Service Provider

Credits

Credits are units of value purchased by a Service Provider to buy future Leads, text message notifications or other services. We may also offer you free or discounted Credits or offers. If any such offer becomes available, it will be communicated to you at the time of purchasing the membership subscription or subsequently by email. Credits are made available subject to the following terms and conditions:

Credits have no cash value, are not transferrable or capable of being forwarded to any person.

We may in our absolute discretion decide to suspend or terminate the Credits scheme (or any part thereof) at any time by updating our Fees Policy. If we terminate the Credits scheme and you have unexpired Credits at that time, we will either allow you to use them until the expiry date or refund you the amount you paid for the unexpired Credits. Please note that you are not entitled to any refund in respect of Credits which we have given to you for free or are included as part of your membership subscription.

Unused Credits will have an expiry date which is the earlier of (a) the date specified at the date the Credits were furnished or (b) 18 months from the date the Credits were furnished or (c) the date of termination or expiry of this Agreement for any reason.

Registration and Monthly Subscription Fees

For Service Providers jobs are called 'Leads'. If you are a Service Provider who wishes to buy Leads, you must be "Registered" in advance, i.e. you must pay a registration fee plus a certain value of Leads in advance. There is a monthly membership subscription fee deducted from your balance on the first day of each month or shortly after. As and from 28th December 2021 (the "Transition Date"), the monthly subscription will be charged by deducting Credits rather than a euro amount from your credit balance. The minimum monthly Subscription Fee charged after the Transition Date will be 5 Credits per month. There may be other membership subscriptions offered whereby you pay different rates in return for certain benefits and/or where the subscription term is longer(for example quarterly or yearly).

We offer you the Leads by email which match the criteria that you have entered in your profile. You can also log onto the website to view Leads that are available. In addition to this, you can opt to receive Lead notifications by text message and there is a charge per text message for this.

Fees for Leads

If a Service Provider wishes to buy a Lead, he / she can send a text message with the ID number of the Lead, a colon (:) and the price that he / she wishes to pay for the Lead. Currently, the cost of a Lead can be paid for by topping up your credit balance in the manner specified on our website. As and from the "Transition Date", the price of a Lead can only be paid for by purchasing Credits in the manner specified on our website.

If there are four Service Providers or less, interested in a Lead over an extended period, then the Lead will be sold on a first come first served basis. In the event that there are more than four Service Providers requesting a Lead within the first fifteen minutes then the Lead will go to the four Service Providers with the highest bids.

Lead Refunds

Service Providers can request a refund for a Lead up to 24 hours of purchasing the Lead and up to 7 days of purchasing the Lead in some cases. Any refunds given for Leads are given in the form of Credits. A fair usage policy applies.

Lead Processing and Handling Fees

A processing fee equal to one Credit shall be applied to the Lead at our absolute discretion. If the Lead has a value of less than one Credit, then the processing fee will be equal to the value of the Lead in Credits. The processing fee is non-refundable in the event of a refund of a Lead for any reason.

Text Message Fees

There is a fee for Lead notifications which the Service Provider has opted to receive by text message. Text message fees are applied to your account at the end of each day. You must have a minimum of 10 euro on your account before the Transition Date or 10 Credits on your account after the Transition Date in order to receive Lead notifications by text message.

You can opt out of receiving Lead notifications by text message by logging into your account and clicking on the link that says, 'Edit Profile' and on this page you can untick where it says, 'I would like to receive priority notification of leads by Text Message'. If you opt out of receiving text messages at any time, the balance of fees due for text messages will be deducted as Euros from the credit balance on your account before the Transition Date or as Credits on your account after the Transition Date at the end of that day. There is no fee for receiving Leads by email and there is no fee for receiving text messages which are not Lead notifications. The fees that we charge you per lead notification by text message are outlined below:

14cent + VAT per lead notification by text message up to Transition Date; and

0.17 credits per lead notification by text message as and from the Transition Date.

Payment Processing Fees

A payment processing fee shall be applied to all payments made by the Service Provider at a rate of €3.50 or 3.50% of the value of the payment (whichever is greater).

Payment methods

We accept payments by credit card, debit card, and bank transfer. Credit and debit card payment usually process straight away, please allow up to 3 weeks for payment by bank transfer to update on your profile. For certain subscription packages, we hold your payment details on a bank certified and approved payment-processing service which takes payments automatically at the beginning of each subscription period. If any transactions took place in the previous month, you will receive an email with instructions on how to log into the website and view your account statement and invoices. You may also receive reminders on how to view your account statement even if there were no transactions in the previous month. You acknowledge that you will not receive an email about your account statement if you are unsubscribed. Furthermore you acknowledge that you will not receive emails from us unless you provide us with a valid email address and make sure that the email address on your profile is kept up to date. It is the Service Provider's responsibility to ensure that its email address is current and valid at all times.

Arrears

Invoices are normally paid immediately but where accounts fall into arrears, they must be settled within 7 days. Accounts in arrears that are not settled within 60 days will be suspended.

Active Account

An "Active Account" is an account of a Service Provider who has paid the registration fee, purchased Credits, Leads, text message notifications or other services in any preceding 12-month period.

Unsubscribed Account

An "Unsubscribed Account" is an account of a Service Provider who had previously Registered on our website and subsequently unsubscribed. An Unsubscribed Account will not receive newsletters, lead notifications, account statements, or any transactional or marketing communications and cannot purchase leads.

Suspended Account

A "Suspended Account" is an account of a Service Provider who had previously Registered on our website and had been subsequently suspended. A Suspended Account will not receive newsletters, lead notifications, account statements, or any transactional or marketing communications and cannot purchase leads.

Inactive Account

An "Inactive Account" is an account of a Service Provider who had previously Registered on our website but had not submitted the required screening information within 12 months of registering or had not purchased Leads, subscriptions, text message notifications or any other service in any preceding 12-month period.

Where a Service Provider has an Inactive Account and he / she wishes to re-avail of the service he / she shall be required to submit some or all of the screening information again and to pay a further registration fee.

Inactive Balance Charge

If an account of a Service Provider becomes an Inactive Account, a monthly inactive balance charge of €2.50 + VAT (or the credit balance on your account, if lower) ("Inactive Balance Charge"), will be automatically charged and applied to his/her account.

To prevent an Inactive Balance Charge from being applied to a Service Provider's Account, he/she simply needs to submit any outstanding screening information and process a transaction on his/her Account(e.g. by purchasing a Lead, purchasing Credits, or by topping up his/her account).

Accounts that have been Unsubscribed, Suspended or Inactive for 5 years or more will be deactivated and any unused credit will be forfeited. Unused credit will be forfeited where the Service Provider has asked for a refund but has not provided us with bank details and proof of identity.

Transition Date

As and from the Transition Date, Service Providers can only purchase Leads by purchasing Credits and any credit balance (expressed in Euro) standing on Active Accounts shall be converted to Credits thereafter.

Profile

We will continue to maintain your profile while there is a credit balance or Credits on your account. Your profile includes but is not limited to your contact details, a description of your services and references and reviews you have received from customers. We cannot guarantee that your profile will be maintained if you do not keep a balance on your account or if you have not purchased Credits, Leads, text message notifications or other services in any preceding 12-month period.

Cancellations and Refunds

You can cancel your membership during the first 14 days after registration ("Cooling Off Period"). Once you pay the registration fee, you may be asked to provide certain information for screening purposes. The type of information we may require is outlined in our Conditions for obtaining leads. You are also asked to read and agree to our Tradesmen Code of Conduct. On payment of your registration fee, you will be deemed to have read and accepted these terms and conditions, codes and policies.

Once we have received the information that you have submitted, a decision will be made on your registration. If your registration is successful, you will be able to start buying leads shortly thereafter. If your registration is not successful you will be entitled to a refund of your registration fee as long as you have not submitted any information which was deliberately misleading, untrue or fraudulent. If you do not submit the requested information and you do not cancel your registration within the Cooling Off Period, you will not be entitled to a refund of the registration fee.

If you want to change or cancel your subscription, you can do so by contacting us via our contact form. If you wish to cancel your subscription after the Cooling Off Period, you must give 10 days’ written notice. You will continue to be able to use the subscription until the end of the subscription term specified at the time the subscription is purchased; your subscription will not be renewed after the relevant term expires, and you will not be eligible for any refund of the subscription fee or part thereof. By subscribing, you authorise Tradesmen.ie to charge your provided payment method at the beginning of any subscription term and at other times that you choose in the 'Top up by Credit Card' section of your account.

If you request a refund after 14 days have passed, you will not be entitled to a refund of the registration fee, Credits or credit balances.

Any refund before 14 days have passed will be subject to deductions for any outstanding fees and charges that you have incurred. If you have made the payment by credit or debit card, we can return the money to your card as long as the card has not expired. If your card has expired, we can return the money by bank transfer.

We will also require proof of identity to make the refund.

You are not entitled to a refund if any of the information provided in your registration is found to be false or cannot be substantiated. In addition to this, you are not entitled to a refund if you had previously registered with us and were suspended from using our service.

Inactive, Unsubscribed or Suspended Accounts with a credit balance of €8 or 8 credits or less will be closed.

With respect to Service Buyers, the 14 day Cooling Off Period does not apply to Featured Jobs as the service is delivered straight away.

Disputes

Any disputes about charges to your account must be submitted to us in writing within 30 days of the date that such charges were incurred.

All disputes which arise between the parties in connection with this agreement, or the subject matter of this agreement, shall be referred to mediation facilitated by a mediator. The mediator will be chosen by agreement between the parties. In default of agreement, a mediator will be nominated by the President of the Law Society of Ireland on the application of either party. In default of resolution at the mediation, the dispute shall be determined by a single arbitrator agreed by the parties (including the mediator if the parties and mediator agree or, in default of agreement, appointed by the President of the Law Society of Ireland) and the decision of the arbitrator shall be final and binding on the parties with regard to the subject matter of the dispute and as to costs. These provisions shall apply to the appointment of any replacement arbitrator where the original arbitrator (or any replacement) has been removed by Order of the High Court, or refuses to act, or is incapable of acting or dies.

Notifications

Please ensure that the email address you registered with us remains active and that you use the same email if you need to contact us as it will help us to deal with your query more efficiently. Please ensure also to check your spam folder in case you miss any of our emails.

Note: Unless specified, all fees exclude VAT. Where VAT is specified same shall be applied etc at the Irish standard rate of VAT.

We may amend our Fees Policy at any time either by giving you notice by e-mail or by posting the amended terms on the Site. Unless stated elsewhere in this Fees Policy, all amended terms shall become effective immediately on the date they are posted on the website and your continued use of the service will be deemed acceptance. If you would prefer not to accept the amended terms, you may terminate your account.
